1. Definitions
ScanPokeCard ("we", "us") is a trade name registered with the Dutch Chamber of Commerce under number 97042706. "User" means any natural or legal person who creates an account or uses the service. "Service" means the online platform for scanning, identifying and managing Pokémon cards.
2. Applicability
These terms apply to all use of ScanPokeCard. By creating an account or using the service, the user accepts these terms.
3. The service
ScanPokeCard lets users upload photos of Pokémon cards, have them recognised automatically and store the results in a personal collection. The service is provided "as is"; ScanPokeCard does not guarantee 100% recognition accuracy.
4. Account
- The user is responsible for keeping their login credentials confidential.
- One account per person. Abuse can result in immediate suspension.
- The user must be at least 16 years old or have parental/guardian consent.
5. Subscriptions and payment
ScanPokeCard offers a free tier and paid subscriptions (monthly or yearly). Payments are processed by Stripe. Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date via the settings page.
6. Right of withdrawal
Consumers generally have a 14-day right of withdrawal. See the Refund & Cancellation Policy for the exceptions that apply to immediately delivered digital services.
7. Limitation of liability
ScanPokeCard is not liable for damage arising from incorrect card recognition, price information from third parties (such as Cardmarket) or temporary unavailability of the service. Total liability is in any case limited to the amount the user has paid for the service in the previous 12 months.
8. Intellectual property
All rights to the software, logo and content of ScanPokeCard belong to ScanPokeCard. Pokémon and all related names, images and logos are trademarks of The Pokémon Company; ScanPokeCard is not affiliated with them.
9. Changes
ScanPokeCard may amend these terms. Material changes are announced at least 30 days in advance by email or inside the app.
10. Applicable law
Dutch law applies to these terms. Disputes are submitted to the competent Dutch court.
